ANALISIS KEPUTUSAN MUSYAWARAH NASIONAL LEMBAGA BAHTSUL MASAIL NAHDLATUL ULAMA TAHUN 2019 TENTANG HUKUM BISNIS MULTI LEVEL MARKETING

Kegiatan ekonomi dalam pandangan Islam merupakan tuntutan kehidupan. Untuk memenuhi kebutuhan hidup yang beragam, manusia tidak mungkin sendirian, ia harus bekerjasama dengan orang lain, antara individu lain atau produsen konsumen. Salah satu bentuk kerjasama dikembangkan dewasa ini adalah sistem penjualan langsung berjenjang sering disebut Multi Level Marketing (MLM). Meskipun bisnis MLM berkembang cukup baik di Indonesia, namun sedikit juga kejadian menunjukkan bahwa masyarakat dirugikan bahkan ditipu ini. Berbagai penafsiran hukum pun muncul dari beberapa ulama, ada menyatakan halal, haram. Pada tahun 2019 organisasi Nahdlatul Ulama (NU) Musyawarah Nasional Lembaga Bahtsul Masail NU membahas mengenai MLM. Penelitian penelitian kualitatif dan termasuk jenis pustaka (library research). Metode pendekatan digunakan yaitu metode yuridis, historis, uṣūl fiqh. Sifat deskriptif-analisis, menggambarkan suatu keadaan subjek, kemudian menganalisisnya. Hasil diperoleh adalah: (1) Hukum tinjauan berdasarkan Keharaman tersebut dimaksudkan untuk skema matahari, piramida ponzi mengandung praktik money game (permainan uang) penipuan. (2) dianalisis menggunakan teori sadd aż-żarīʻah jika dilihat tingkat kerusakan (kemafsadatan) ditimbulkan, pada dasarnya boleh dilakukan karena kemaslahatan, tetapi memungkinkan terjadinya kemafsadatan. Ada 3 (tiga) poin dilarangnya Poin-poin tersebut, yaitu: (a) Rentan terjadi (b) Memperdaya ummat agar tergoda iming-iming, (c) Dampak-dampak ditimbulkan akibat MLM.Kata kunci: Marketing, Sadd aż-Żarīʻah, Munas NU.
